If you were insured on an auto policy issued by the
Interinsurance Exchange of the Automobile Club
between April 1, 1999 and July 31, 2004,
you may be eligible for a payment from a class action settlement.
What is this about?
The Court has preliminarily approved a class action settlement. The settlement is a result of lawsuits challenging the manner in which the Interinsurance Exchange of the Automobile Club (“Exchange”) determined how much to charge drivers who did not have auto insurance during all or part of the year before they bought insurance from the Exchange. The lawsuits allege that the Exchange charged such drivers more than they would have paid if they had continuous coverage throughout the year before they bought insurance from the Exchange.
To be a part of the settlement, you must have been the Named Insured under an auto policy issued by the Exchange between April 1, 1999, and July 31, 2004, that was charged for a Non-Verifiable Driving Record.
Your Legal Rights and Options
1. Do Nothing: If this Settlement is Approved, You Will Receive a Check
If you are part of the settlement class, you will remain in the settlement class and receive a settlement payment if the Court gives final approval to the settlement. As part of the settlement, you will release your claims against the Exchange.
2. Exclude Yourself
You may exclude yourself from the settlement. You will not receive a settlement payment, and you will retain any rights you may have to sue the Exchange separately.
Your exclusion letter must be postmarked no later than November 19, 2007.
3. Object
You may write to the Court and explain why you do not like the settlement. If a settlement is approved, you will be subject to the terms of that settlement.
Your objection letter must be postmarked no later than November 19, 2007.
Regardless of whether you stay in the lawsuit or exclude yourself,
your insurance coverage will not be affected.
